Customer acknowledgement of Restricted Use for Forensic Use Only Products
Customer Name: Product(s) Purchased: Applies to all FUO designated products offered by Medical Distribution Group, Inc.
This notice and waiver serve(s) as a formal acknowledgment of the limited scope of use for Medical Distribution Group, Inc. (MDG, Inc) products labeled as FORENSIC USE ONLY (FUO). This product is labeled for Forensic Use Only and is intended solely for use in criminal justice and law enforcement settings, as specified by federal regulations. It is not intended for use in clinical diagnostics, patient care, or any other medical setting.
This product has not been cleared by the FDA for in vitro diagnostic (IVD) use. The product is not designed, developed, or tested for clinical diagnostic applications. They must NOT be used in a clinical setting for diagnosing ailments, dependency, or illness, as they have not been cleared by the FDA’s Section 510(k) pre-market notification process. The buyer must adhere to these restrictions and assume all responsibility for compliant usage.
1. Restricted Use Acknowledgment
The undersigned acknowledges that all FUO products purchased are restricted to authorized entities such as law enforcement agencies and forensic laboratories. This product may not be sold, marketed, or distributed for home use, over-the-counter sales, or to unauthorized customers, including those outside the specified criminal justice sector.
2. Compliance with Local, State, and Federal Regulations
The buyer acknowledges awareness of and compliance with all relevant legal and regulatory requirements concerning the purchase, possession, and use of FUO products. These products may only be sold to criminal justice system agencies and affiliated laboratories, including police, corrections, probation, parole, judicial courts, and government entities such as the Coast Guard, Department of Defense, Navy, Air Force, Army, and Marines.
3. Assumption of Risk
The buyer assumes all risks associated with handling and storage, acknowledging that improper use or storage may lead to potential liabilities. MDG, Inc is not liable for incidents arising from misuse or improper handling.
4. No Liability for Improper Use
MDG, Inc shall not be liable for any damages or losses from the use of FUO products in a manner inconsistent with their intended forensic purpose or in violation of legal or regulatory requirements.
5. Indemnification
The buyer agrees to indemnify and hold MDG, Inc harmless from any claims, damages, or expenses resulting from unauthorized or unintended use or any breach of this agreement.
6. Acknowledgment and Acceptance
By purchasing this product and by signing below, the buyer acknowledges that they understand and accept the restricted forensic use designation. The buyer assumes all responsibility for regulatory compliance and correct usage as mandated by applicable federal and state laws.
